Terms and Conditions of Sale

1. Offer and Acceptance

These Terms and Conditions (“Agreement”) govern all sales of products and parts (the “Products”) and all repair, installation, and related services (the “Services”) provided by Pro Garage & Gates (“Company,” “we,” or “us”) to the customer (“Customer,” “you,” or “buyer”). By purchasing any Products or Services from us, you agree to be bound by this Agreement.

No changes, modifications, or cancellations will be valid unless approved by Pro Garage & Gates in writing. This Agreement supersedes any prior agreements or representations regarding the same subject matter.

2. Payment Terms

Payment is due upon completion of services or delivery of products unless otherwise stated in writing.

  • We accept major credit cards, debit cards, and other approved payment methods.

  • For custom or special orders, a 50% deposit is required at the time of order, with the balance due upon installation or completion.

  • Late payments may incur interest at the maximum rate permitted under Texas law.

  • Returned or failed payments may result in a processing fee of up to $15 or the maximum amount allowed by law.

3. Pricing and Taxes

All prices are subject to change without notice. Any applicable sales tax, use tax, or other government-imposed fees will be added to the total purchase price. Written quotes are valid for 30 days unless otherwise specified.

4. Delivery and Performance

All delivery and installation dates are estimates only. Pro Garage & Gates is not liable for delays caused by weather, supply shortages, transportation issues, or other events beyond our control. Once Products are delivered or installed, all risk of loss passes to the Customer.

Customers must provide reasonable access to the premises for service and installation. If we cannot perform Services due to lack of access or unsafe conditions, additional fees may apply.

5. Cancellation Policy

Customers may cancel any standard order within three (3) business days of purchase for a full refund.
Custom or special orders may be cancelled within three (3) business days of the order date. After that period, cancellations may incur costs equal to the actual expenses incurred by Pro Garage & Gates for materials, labor, or other fees related to the order.

6. Limited Warranty

Pro Garage & Gates provides a limited warranty on all Services and will honor any applicable manufacturer warranties on Products.

  • Service warranties cover defects in workmanship for 90 days from the date of service completion.

  • Product warranties vary by manufacturer; we will provide warranty information upon request.
    This warranty does not cover damage caused by misuse, neglect, accidents, unauthorized modifications, or normal wear and tear.

7. Limitation of Liability

To the fullest extent permitted by law, Pro Garage & Gates shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use any Products or Services. Our total liability under any claim shall not exceed the total amount paid by the Customer for the Product or Service at issue.

8. Indemnification

Customer agrees to indemnify and hold harmless Pro Garage & Gates, its employees, and contractors from any claims, damages, or expenses (including legal fees) arising out of Customer’s misuse of Products, failure to follow instructions, or negligence.

9. Force Majeure

We are not responsible for delays or failure to perform due to circumstances beyond our control, including natural disasters, extreme weather, power outages, strikes, supply chain disruptions, or government actions.

10. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any legal disputes shall be brought exclusively in the courts located in Galveston County, Texas.

11. Changes to Terms

Pro Garage & Gates reserves the right to update or modify these Terms and Conditions at any time without prior notice. The version posted on our website at the time of purchase or service shall govern.

12. SMS/Text Messaging Terms

By providing your phone number to Pro Garage & Gates, you consent to receive SMS and MMS messages from us regarding appointments, service updates, estimates, promotions, and account-related notifications.

Message Frequency: Messages may be sent up to 2 times per week.
Message & Data Rates: Message and data rates may apply.
Opt-Out Instructions: You may opt out at any time by texting STOP to 832-847-8622.
